SENIOR Advocate of Nigeria (SAN) Femi Falana has filed a $5 million lawsuit against Meta Platforms Inc., the U.S.-based parent company of Facebook, at a Lagos High Court, alleging a breach of his privacy.
Falana through his lawyer, Olumide Babalola, claims that Meta published a video on its platform, www.facebook.com, under the page “AfriCare Health Center,” falsely stating that he suffers from prostatitis.
He argues that this constitutes an invasion of his privacy, as protected under Section 37 of Nigeria’s 1999 Constitution.
The lawsuit, filed under the Fundamental Rights Enforcement Procedure Rules 2009, references Section 37 of the 1999 Constitution (as amended), as well as Sections 24(1)(A) and (E) & 34(1)(D) of the Nigeria Data Protection Act 2023.
Falana asserts that the video, which includes his name, image, and a voice-over, is false, misleading, and damaging to his reputation.
As a remedy, Falana seeks:
A court declaration that the publication constitutes an invasion of his privacy.
An order compelling Meta to remove the video from its platform.
$5 million in general damages for the harm caused to his reputation.
Falana argues that the false publication has severely impacted his image and professional standing, portraying him in a negative light and causing him emotional distress.
He insists that he has never suffered from prostatitis and has had no dealings with Meta regarding his health.
In his affidavit, Falana highlights his long-standing legal career, known for defending human rights and challenging government policies.
He argues that Meta’s failure to verify the claims before publication was reckless and done to generate traffic and advertising revenue.
The case underscores concerns over digital privacy and misinformation, with Falana urging the court to protect his reputation from further harm.
