THE Supreme Court has scheduled May 26, 2023 as the date for its decision in a complaint seeking the disqualification of Bola Tinubu and Kashim Shettima as the All Progressives Congress (APC) presidential and vice-presidential candidates, respectively.
In a suit filed in July 28, 2022, the PDP filled a complaint that Shettima’s selection as Tinubu’s running mate violated sections 29(1), 33, 35, and 84(1)(2) of the Electoral Act 2022.
The party argued that Shettima’s nomination to run for Vice President and the Borno Central Senatorial District seat at the same time violated the law.
The PDP requested an order disqualifying the APC, Tinubu, and Shettima from running in the presidential election, as well as an order declaring their candidacies null and void.
The lawsuit, however, was dismissed by Justice Inyang Ekwo of the Federal High Court on the grounds that the PDP lacked locus standi to file it.
The PDP filed an appeal after being dissatisfied with the ruling.
In its decision on the appeal, a three-member panel of the Court of Appeal led by Justice James Abundaga found that the PDP had failed to establish locus standi to bring the case.
Abundaga described the PDP as a distraction who meddled in APC internal affairs.
The appeal however was dismissed by the judge because the PDP failed to demonstrate its locus standi.
