THE Supreme Court has denied Atiku Abubakar’s request for new evidence against President Bola Tinubu.
Justice Inyang Okoro today, delivered the ruling at the Presidential Election Tribunal Court (PEPC) during the hearing of the appeals filed against Bola Tinubu’s victory.
Atiku had asked the court for permission to produce more evidence to prove Tinubu filed a fraudulent certificate to the Independent National Electoral Commission (INEC) which according to Atiku, tis the case.
Chris Uche (SAN), Atiku’s counsel, said the 32-page document released to his client should be admitted in the interest of justice.
However, Justice Okoro stated that the deadline for admitting such material had passed. He referenced Section 285(5) of the 1999 Constitution, as amended, which states that the PEPC must hear and decide all presidential election petitions.
He argued that because the 180-day period had elapsed on September 17, the Supreme Court lacked jurisdiction to hear the case.
