THE Supreme Court has today postponed its decision in the appeal brought by the All Progressives Congress (APC) governorship candidate, Patrick Tonye-Cole, challenging the victory of Rivers State governor, Siminalayi Fubara in the March 18, 2023 governorship election.
This appeal stems from the Appeal Court’s dismissal of Tonye-Cole’s appeal as lacking sufficient evidence.
The APC candidate’s argument revolved around irregularities, non-compliance with the Electoral Act, as well as Fubara’s alleged continuation of signing documents as the Rivers State’s Accountant-General after his nomination as the governorship candidate of the People’s Democratic Party (PDP).
Patrick Tonye-Cole’s appeal is directed against the Independent National Electoral Commission (INEC), the PDP, and Governor Fubara.
After all parties in the case presented their arguments, the five-member panel, led by Justice Kudirat Kekere-Ekun, reserved judgment on the appeal.
Additionally, the apex court dismissed the appeal of Innocent Kere of the Allied People’s Movement (APM) following its withdrawal by his counsel.
